In April 2011, Apple sued Samsung alleging that the manufacturing company infringed on multiple patents from its iPhone interface for its Samsung Galaxy Tab mobile phone. Surprisingly, Samsung filed a counterclaim against Apple also alleging patent infringement. Ironically, Apple and Samsung have maintained a business relationship with Apple purchasing $6 billion worth of technology components in 2010 from Samsung, which include various chips and processors. Samsung also manufactures products for Apple's competitor, Google with various phones with the Android platform. The U.S. Patent and Trademark Office says that patent infringement occurs when a "party makes, uses, and sells any patented invention" within the United States. Here, the main infringement in question is Apple's design of its icons and its iPhone functionality. The technology sector has grown accustomed to frequent patent infringement, trademark infringement, and copyright infringement lawsuits, since the rapid speed of technological innovations has created a constant rat race for competitive advantage. Apple recently sued Amazon for trademark infringement, and even Apple has been sued by numerous other corporations for patent infringement of its iPhone design. Strategically, a patent infringement lawsuit provides a sneaky method for technology corporations to drain the resources of their competitors by embroiling them in costly legal exchanges to defend corporate reputations. On the other hand, patent infringement lawsuits also serve to help corporations protect their brands. However, in today's technological environment, Apple, Microsoft, Google, and others have made it difficult to determine the legitimacy of each corporation's patent claims, especially given Apple's recent fine of $600 million dollars for infringement and what can be viewed as Microsoft's hypocritical claims of anti-trust violations against competitors. Undeniably, patent infringement lawsuits offer big business incentives to technology corporations. With patent infringement law, companies, like Apple, can be awarded legal injunctions to prevent other competitive corporations from selling certain products in the marketplace. Thus, technology companies can eliminate business threats to their market share through court. The negative effect of patent infringement claims was evident when the announcement of Apple's patent infringement lawsuit caused Samsung's stock shares to decrease. Still, Samsung is one of the largest Asian technology companies with a $140 billion value and the Samsung Galaxy Tab still remains available for sale. Not to be outdone, Samsung alleges that Apple stole its intellectual property related to "technology to optimize data transmission" and "tethering mobile phones to PC." Although Samsung's counterclaim neglects to address Apple's original claims of patent infringement, the lawsuit will increase the work of Apple's legal team. Legal analysts suggest that the practice of suing and counter-suing for patent infringement is a technique known as "mutual assured destruction" of patents. Under this practice, no party receives the true benefits of patent protection, because both parties fear the threat of retaliation in patent infringement lawsuits and companies diminish the value of patent infringement protections. This situation seems to be the case between Apple and Samsung. They have sued each other, but neither corporation is guaranteed to benefit largely from a win after spending a great deal of time and money in legal expenses. Luckily, both Apple and Samsung earn billions of dollars in profits to continue the development of new innovative products, while dueling out their alleged patent infringement claims in the legal system.
